The case was tried for five days before a jury and resulted in a verdict for our client in the amount of $1,395,000.

$1,667,000 Jury Verdict – Brain Injury (Construction Accident)
While working off of a ladder, the client passed out and fell over 25 feet to the ground. He suffered a fractured lumbar spine and a mild traumatic brain injury. By the time of the trial, the client had returned to work but was moving from job to job because of a changed personality and attention problems caused by the brain injury he had suffered during the fall. The defense argued at trial that the client’s work problems were exaggerated and were not the result of a brain injury. They jury found for the client. This award was reduced to $850,000 for the client’s comparative fault.

The victim was involved in a semi-truck accident while attempting to turn left during inclement weather. The injured motorist never saw the approaching truck, which had not turned on its headlights, was black, and was covered with a black tarp. The plaintiff suffered a severe traumatic brain injury. The settlement proceeds were used to establish a special needs trust to provide the victim with funds for ongoing rehabilitation and to allow the victim to maintain Medicaid assistance.
